FTC (The Federal Trade Commission) has charged a payday loan lender for using illegal debt-collection practices, such as garnishing borrowers' wages. FTC is aimed at ceasing illegal practices and call for payday loan lenders to return the money they had collected illegally so that cheated borrowers could get refunds.

FTC charges the operators doing business as Ecash and GeteCash, providing short term loans of up to thousand dollars that on due time is supposed to be paid back from a borrower's upcoming paycheck. The thing is that the operators require their customers to check the box indicating their agreement with loan terms. According to these terms the lender is allowed to garnish wages of a person defaulted in paying back. Such terms are illegal as the federal requirements enable individuals to revoke a garnishment agreement. Having customers to check the box of agreement payday loan lenders tried to get over the requirements. It is necessary to draw attention to the fact that the statement enabling lenders to garnish wages was written in a way that individuals could easily fail to notice it.

Garnishing wages is only possible for employers in case the employees owe the governmental money. It comes evident that no lender is allowed to do it, as lenders don't have the same collective rights as the government. FTC also insists on the operators being punished for stating that their customers knew their money would be garnished. GeteCash also violated the law having informed borrowers' employers and colleagues of their debts without asking permission for that.

The complaint was filed according to the voting which resulted 4-0. It was filed in the U.S. District Court for the District of Utah, Central Division on March 15, 2010.
